Majilis of Kazakhstan to postpone examination of the law on bank secrecy

/IRBIS, March 14, 00/ - REUTERS informs, with the reference to the speaker
of Majilis Jarmakhan Tyuakbaev, that the Majilis, one of the houses of
Kazakhstani parliament, postponed the examination of the draft law on bank
secrecy and recommended the government to recall it for further detailed
preparation.
Previously, the draft law was adopted by the Majilis, but at the approval
process of the Senate the government asked the senators to make it easier
for fiscal bodies to arrest expense accounts of legal entities by substituting
attorney's sanction into written notification, informs the agency.
After the Senate's agreement, the draft was sent to the Majilis where some
inconsistencies with current law were found such as the case when the
money or other property is to be arrested by the officers of the court on the
judge's writ.
"We suggested to complement this clause "with the sanction of the attorney",
however, unfortunately, we have execution papers possessed by the officers
of the court that are approved on the judge's writ, and we can not impose
sanctions on the judge's writ", said Tyuakbaev.
Therefore, he added the draft had to be studied carefully and probably the
government should recall it.
The law on bank secrecy that means imposing strict measures on disclosure
of deposit secrecy was declared by the president Nursultan Nazarbaev as
the "urgent" law though it had received negative reactions from customs and
tax bodies, and which delays its adoption time.
It is said due to discrepancies about the bank secrecy the parliament has
little time to adopt the law. And the parliament has to adopt it within a month
since the president declared the law as "urgent", unless the president may
sign it as a decree with the power of the law.
The draft law was sent to the parliament for consideration on February 17
and March 17 is the deadline for the adoption.
