Alma Telecommunications Kazakhstan says court ruling restored its rights violated as a result of the relay of Muzlife TV channel

/KASE, October 31, 2018/ – Alma Telecommunications Kazakhstan (Almaty), whose shares are officially listed on Kazakhstan Stock Exchange (KASE), has informed KASE as follows:

On October 17, 2018, the Appeallate Board for Civil Cases of the Almaty City Court found that the Muzlife TV channel (hereinafter, the TV channel) violated its obligations and guarantees provided under the agreement to Alma Telecommunications Kazakhstan JSC (hereinafter, Alma TV) and also ruled to recover KZT36.7 mln from the TV channel in favour of Alma TV. The court also found that the responsibility for the failure to provide "cleared" rights to the objects of copyright and related rights of third parties when relaying the TV Channel via Alma TV’s cable networks is assigned to the TV Channel under the contract, and the operator was providing only back-toback daily relay of the TV channel without changing its programs. Alma TV performed only a technical function of delivering signals of the TV Channel to the end users not being the user of objects of copyright and related rights.

Also as of September 1, 2014, there was a direct ban to transfer non-exclusive rights to use the works, the rights on which belonged to third parties to any third parties on the Muzlife TV channel in effect. Thus, the Muzlife TV channel has misled Alma TV about the volume of its rights to the works. As a result, Alma TV the amount of compensation was unreasonably recovered by the court in favour of the National NGO "The Kazakhstan Society for Intellectual Property Rights Management".

The Appellate Judicial Board of the Almaty City Court has restored justice by overturning the ruling of the court of first instance and issuing a ruling on recovering the damages incurred by Alma TV from the Muzlife TV channel.

"Today we see the result of recent explanations of the Supreme Court of the Republic of Kazakhstan, due to which, when considering the case related to the possession and use of copyright and related rights by the a TV channel and a cable operator, the appellate court issued a justified and lawful ruling".
