The court satisfied the suit of Turgay-Petroleum against PetroKazakhstan's "daughter" about return of about 400 th. tons of oil

/INTERFAX-KAZAKHSTAN, Almaty, June 6, 05/ - Kyzylorda specialized
interdistrict court has satisfied the suit of Turgay-Petroleum JSC brought
against PetroKazakhstan Kumkol Resources JSC (PKKR), which belongs to
PetroKazakhstan Inc., about return of 394 th. 719 tons (about 3 m. barrels)
of oil.
"On June 1 of 2005 the court satisfied the suit of Turgay-Petroleum in full
volume having obliged PKKR to give to Turgay-Petroleum 394719 tons of
oil", - press-release of Turgay-Petroleum spread on Monday says.
The release the question about compensation of losses to the joint venture
because of non-unloading of 20 th. tons of oil will be examined in a separate
case.
In accordance with oil extraction technology crude oil of Turgay Petroleum is
given to PKKR for primary preparation and further transportation to the trunk
system of KazTransOil.
In December of 2004 in defiance of contract obligations PKKR stopped
receiving crude oil of the JV and its transferring to KazTransOil's system.
On December 29 of 2004 the court obliged PKKR to give to KazTransOil oil
of Turgay Petroleum. In the first quarter of 2005 out of 891 th. 521 tons of
oil given by Turgay Petroleum to PKKR only 476 802 tons were unloaded to
KazTransOil in accordance with directions of Turgay Petroleum. At that 20
th. tons of oil were not unloaded because of securing measures of the court
on the withdrawn by now suit, which had been brought against
PetroKazakhstan Inc.
"Thus, PKKR has actually appropriated 394719 tons of Turgay Petroleum's
oil, - the message says.
It also says "Turgay-Petroleum's attempts to solve the conflict by
negotiations were rejected", and in accordance with that on May 13 of this
year the company brought a suit against PKKR about giving back the
mentioned quantity of oil.
Turgay Petroleum and PKKR develop, correspondingly, the northern and the
southern areas of Kumkol field. At that capacities on the JV's commodity oil
preparation are situated on the contract territory of PKKR and belong to the
latter one.
The conflict between shareholders of Turgay Petroleum JV, and governing
body of this venture and PetroKazakhstan last for several months. The sides
raise claims against each other concerning the joint business, also
judicially.
