/KASE, April 2, 09/ - Today Kazakhstan Stock Exchange (KASE) sent to the
office of newspaper "Vremya" a requirement to disprove false information
released in the article by A. Konovalov "Chie Chutie?" ("Whose instinct"),
published in No. 46 (819) of the newspaper dated April 1, 2009.
Initially the office of newspaper "Vremya" addressed KASE with letter No. 412
dated March 30, 2009 with a request to confirm information allegedly published
at the KASE website in regard of purchase by Halyk Savings Bank of Kazakhstan,
Open unit investment fund Kazyna and Almaty Investment Management of large
amounts of currency at a day session on February 3, and explain the reason why
the KASE Exchange Council decided to remove Almaty Investment Management
from KASE membership since March 27, 2009...".
In its letter dated March 31, 2009 No. 10008/601 KASE reasonably answered that
all suppositions of the newspaper office are false. The letter was received by
the newspaper office in the afternoon of March 31, 2009.
However, April 1, 2009 the "Vremya" released the article ignoring responds and
comments of KASE.
As almost all information in the article with references to the KASE website as
the information source is false, today KASE addressed to the "Vremya" with
letter No. 10008/620 dated April 2, 2009 requesting to release disproval.
At that, KASE indicated that:

1)your request No. 412 dated March 30, 2009 was replied by letter
No. 10008/601 of Kazakhstan Stock Exchange (the Exchange) dated
March 31, 2009, which your office received by fax in the afternoon of March
31, 2009. Accordingly, at the moment of preparation of the newspaper
issue for April 1, 2009 you had already got our respond, containing detailed
data on the volume of trade in USD in the period December 1, 2008 -
February 4, 2009, and also the data on the average daily volume of trade in
USD in December 2008 - January 2009. Besides, our letter contained
substantial comments, having ignoring which caused release of false
information;
2)the Exchange is not releasing information on the volume of demand for
currency on the side of exchange trades participants. Therefore, your
author is writing lies, referring to the Internet-site of the Exchange as the
information source;
3)mentioned data on results of exchange trade in dollars in December 2008
- January 2009 do not comply with our statistics, which were sent to you in
our letter dated March 31, 2009;
4)your author could not receive from the Internet-site of the Exchange
information on the sides of concluded on February 3 (and March 3, 2009as
well) exchange deals in USD: the Exchange never and under no
circumstances is releasing openly names of the sides of exchange deals in
financial instruments, as the similar information is a protected by law
commercial and official secret of the Exchange and exchange members.
Admissible exceptions shall in no way apply to the article "Chie Chutie?".
Therefore, your author is writing lies again referring to the Internet-site of
the Exchange as the information source;
5)as soon as Open unit investment fund Kazyna (which, by the way, in
accordance with the Law of the Republic of Kazakhstan "On Investment
Funds" is not a legal entity) and Almaty Investment Management are not
exchange members in category "B" (entitled to trade in currency), your
author physically could not receive at the Internet-site of the Exchange the
information on the clients of exchange members, in the interests of which
the dollars were bought: the Exchange never released and may not release
names of actual sellers and buyers of financial instruments, as it is in
relations with exchange members exclusively, but not their clients.
Accordingly, your author is writing lies again referring to the Internet-site
of the Exchange as the information source.
In addition, we request to pay attention to the following facts in regard of the
content of the article "Chie Chutie?":
- information on reasons of removal of Almaty Investment Management from
the Exchange membership in all categories is open and was released at
the Internet-site of the Exchange on March 6 and 27, 2009. At that, the
Exchange Council decision on removal of Almaty Investment Management
from exchange members in all categories was made not on March 27, but
on the March 26, 2009, of which the Internet-site of the Exchange informs;
- on February 27, 2009 the Board of the Agency of the Republic of
Kazakhstan on Regulation and Supervision of Financial Market and
Financial Organizations adopted resolution No. 29 on depriving of Almaty
Investment Management of license on carrying out broker and dealer
activity on the securities market with the right to maintain client accounts
in the capacity of a nominal holder. This information was released at the
Internet-site of the mentioned state body (www.afn.kz) on March 5, 2009.
Correspondingly, it was not necessary for your author to create intrigues in
regard of the publicly known fact;
- we are not authorized to disclose data in regard of participation of Halyk
Savings Bank of Kazakhstan in exchange trades in dollars on February 2-
3, 2009, however, possessing such data, we with responsibility are stating,
that the statement of your author "exactly on February 3,... Halyk Savings
Bank of Kazakhstan jointly with its affiliated companies bought $1 bn." is
disinformation and has no grounds under.
